We, Job Invest are responsible for the processing of personal data as reflected in this privacy statement (Controller within the meaning of the AVG).
When do we collect your personal data
We collect your personal data if, for example;
- You visit our website or use the flex or client portal;
- You enter or leave data on our website;
- You create an account on the website or through the flex or client portal;
- You are enrolling yourself;
- You otherwise apply or are notified to use our services or to provide you with a service.
And if we did not get this directly from you, we collect data;
- From social media, only if we have a legitimate reason to believe that you would be interested in a job. In that case, we will approach you to see if you might be interested in registering with us or otherwise using our services. If you are not interested, we may process relevant data from you to take into account your desire not to be contacted by us;
- If we receive personal information from or reference contacts provided by you;
- If clients, where you have been offered or where you work or have worked, share personal information about you with us or who sign you up for our services;
- From suppliers in the context of in- and on-lending, in which case we have agreed with the supplier to inform and refer to our privacy statement.
From whom we collect personal data
Visitors and users of the website
In general, you can visit our website - www.jobinvest.nl- visit without your personal data being transmitted to us.
Once you visit the Job Invest website, non-identifiable information is collected related to the type of device, browser and how you use our website, such as: date and time of access, the source from which you linked directly to our website, the operating system you are using, the parts of the website you visited including the pages of the website you visited. This information helps us improve the websites for your convenience and to provide you with the best possible service.
We process the information:

- To properly execute the agreement and/or terms of use agreed to with you
To make our website work optimally, we use cookies and web statistics. We do this to see how visitors use our website. A cookie is a file that is stored on your computer. On a subsequent visit to our website, these cookies can be recognized.
Once you provide data to us, by filling out a form, making an application or registering where you create an account, we process the data you provide to us. We only ask you to provide us with information that is accurate and relevant.

Applicants, (potential) candidates, flex workers, internal staff members Job Invest and/or other persons
We collect and process your data for the performance of our hr and recruitment services, including mediation, staffing, secondment, payroll, recruitment & selection, personal development and employability, reintegration, career guidance, consulting, planning and personnel and payroll administration. Without this data we cannot perform our services.
- To properly execute the agreement and/or terms of use agreed upon with you;
- To comply with a legal obligation;
- Based on a legitimate interest consistent with or resulting from the stated purposes;
- In limited cases: with your consent, where this is possible and you are free to give this consent. (If you are under 16 years of age, we need the consent of your parents or the person with parental responsibility).
- To provide you with offers and/or information about services and other activities and to better tailor them to your needs and qualities;
- To process or respond to your feedback or complaints in order to improve our services and resources or better serve you;
- To improve our services;
- To assess your suitability and availability in connection with mediation for permanent or temporary work or an assignment, which may also involve the use of test results, reference checks, social media (only if truly relevant to the position);
- To understand companies where or through whom you may be employed or how we can support or advise you in your job search;
- To introduce you to our clients, this may also be by means of audio and/or visual material, in the case of videos or photos: only if you have voluntarily provided them to us, or have had them provided to you; to schedule you as best as possible according to your wishes and availability and the possibilities with our client;
- To establish and maintain an employee or personnel/agency relationship with you and to perform the relevant administration for this purpose;
- To fulfill our reintegration obligations and to comply with (the government-imposed) purposes of helping persons with a large(er) distance from the labor market into work;
- To carry out the necessary actions and administration in case we are self-insurer;
- Record an assignment with the client in an agreement with the client and maintain and fulfill the agreement with the client;
- To promote your personal and career development and employability, including through training, education and testing;
- For management purposes including; management information, providing internal controls and corporate security and performing audits and auditing;
- For quality purposes such as certification;
- In order to claim subsidies, premium discounts, labor cost benefit and the like;
- If we have entered into an employee or staffing/mediation relationship with you, for compliance with laws and regulations, including but not limited to identification, labor laws, tax and social security laws, pension, anti-fraud and national and international sanctions laws;
- For marketing purposes in case of film or photo shoots; a consent form with personal data pointing out portrait rights and the use of footage is part of this.
Additional information may be desirable to better tailor our services to your needs, qualities and/or availability or to meet more specific questions or obligations regarding the position and/or from clients. We ask that you only provide us with information that is accurate and relevant.
We may also collect (contact) data from you if you have posted it on public resources or channels (e.g. Linkedin), only if we have a legitimate reason to believe that you would be interested in a job or our services. In that case, we will approach you to test your interest to register with us in accordance with our terms and conditions and subject to this privacy statement. You are responsible for any personal data that is available about you on the Internet. Check this regularly and if you do not want information to be available to third parties, screen it properly.
More specifically, this includes - among others - the following (documents containing) personal data:
Upon registration;
- Name and address information, e-mail address and other contact information;
- Birth data, age, gender;
- Curriculum vitae (CV), information on education, internships and work experience;
- Data on training and education and/or testing you have attended or taken yourself or through us;
- Availability and leave data;
- Other data that are or may be important in the context of assessing your suitability as a candidate, for example, references and testimonials;
- Voluntary passport photo.
A copy of the ID document may be stored and checked during recruitment and selection to verify whether you are allowed to work in the Netherlands. If you do not start working for us within four weeks, the ID document will be removed.
We request data about your gender to communicate with you, data about age to identify you in our systems and to determine whether we have certain obligations (such as with respect to wages and whether we need parental or guardian consent).
At the time you can start working/working/have worked for us;
- Nationality, BSN number, ID proof, work permit;
- Other data related to personnel, salary and absence records;
If you are hired in and on through us to a client;
- Data necessary in the context of the limitation of hirer's liability (such as name and address, date of birth, BSN, type of ID document, number and period of validity, if any: residence permit, A1 certificate, work permit).
In some cases, we also record special personal data if it is necessary to fulfill our legal obligations, or if otherwise permitted by law. With ‘special personal data’ is meant; genetic and biometric data, health data, criminal personal data and/or personal data about unlawful or annoying behavior, ect. for this capture, explicit consent will be requested separately.
Employees of suppliers, clients and other business associates
We process personal data of individuals working for companies with whom we do business (1) to provide information about services and other activities, (2) to maintain business relationship and (3) to enter into and maintain an assignment agreement.
We process the information:
- To properly carry out the agreement and/or terms of use agreed with you;
- To comply with a legal obligation;
- Based on a legitimate interest consistent with or resulting from the stated purposes; (why do we process personal data) we do so based on careful assessment and balancing of interests
- By virtue of your consent
What personal data do we collect from you?
- Name and contact information;
- Function;
- Details of the company you work for or represent;
- Data to maintain a good business relationship with you;
- Data for the purpose of events and meetings.
We collect your data to:
- To establish, maintain and fulfill the agreement with you;
- To be able to communicate with you;
- Maintain a good business relationship with you, to;
- Providing you with offers, promotional gifts and/or information about services and other activities;
- To contact you for commercial offers, newsletters, events and promotions that may be of interest to you, only if you have opted-in.
- To bill;
- To determine creditworthiness;
- And provide you and/or your colleagues with access to the portal and set up account management;
- For reporting purposes (for example, to provide the right person with the right report);
- Process or respond to your feedback or complaints in order to improve our services and resources or better serve you;
- Improve our services.
How long do we keep your data?
We retain data of (potential) candidates, job applicants, flex workers, internal TodayHR staff, employees of suppliers, clients and other business relations to fulfill the purpose for which it was collected. The required retention period depends on the relevance of the data to maintain or record our relationship and we determine this based on laws and regulations and any claim risks, with the guiding principle being that we do not retain data longer than necessary.
With potential candidates, job applicants (if you have not (yet) worked for us) this means that your mediation data (CV, work experience, education, test results etc.) will be available for up to two years after the last contact if you have not worked for us.
For flex workers or internal staff (if you work or have worked for us), this means that your personal data are available for up to two years after the end of employment. Certain personal data are available to us for longer periods for purposes such as claims, audits and tax obligations.
Should you no longer wish to be mediated, you can indicate this, if applicable, to your contact person with us. Your account will then be deleted and you will no longer be contacted or mediated by us. Upon registration, your personal data will remain available in a protected environment for three calendar months (for recruitment and selection this period is 24 months) in connection with claim risks. In the case of flex workers and internal staff, your personal data are archived in a protected environment after two years.
In the protected environment, your data is only available to us under strict conditions in accordance with the purposes and deadlines set for it. After expiration of the aforementioned periods, your data will be permanently deleted.
If clients have an account in the client portal, personal data related to this account are available for two years after the last posting.
Sharing your personal data
We may disclose your personal data to the following (categories of) recipients;
- Companies that are part of Job Invest;
- Subcontractors and suppliers (such as data processors) who provide services or perform tasks on our behalf. These recipients only have access to the data they need to perform the required tasks and are bound by contractual obligations;
- Third parties such as service providers who perform functions on our behalf (including testing, training, and/or examination institutes, parties who do customer satisfaction measurements among other things for the purpose of labels and certifications, external consultants, business partners and professional advisors such as lawyers, auditors, technical support functions and IT consultants who develop and test our systems);
- Clients where we can introduce you, where you are or will be working through us, or who ask us to use our services for your career guidance, coaching, mediation or outplacement;
- Individuals and organizations that have information about, for example, your reference or eligibility (such as diplomas) or to whom we, at your request, provide data or who, at your request, provide us with information, such as current, former or intended employers, training providers, examination institutes and employment agencies;
- Third parties to whom we provide data, with your express consent, or share data at your request with data portability;
- Pension Fund, if applicable;
- Government agencies and other entities (such as grant applicants) if we believe we are required or entitled to do so.
And in all other cases in which we are required to do so, such as by court order or court judgment.
The sharing of personal data is done on the basis of a legitimate interest, consent, legal obligation and/or for the performance of the agreement in accordance with the purposes named above.
Your rights
You have the right to request for;
- Access the personal data we process about you;
- Rectification of your personal data;
- Removal of your personal data or restrictions on processing: in certain circumstances, unless we have a good reason, such as a legal obligation, to process or not remove the personal data;
- Restrictions on or an objection about the processing of personal data;
- Transfer of your data.
In case of your request, in order to protect personal data, we will need to be able to establish your identity.
We do not use automated decision making based solely on automated processing including profiling.
For flex workers and clients with an account in Otys/the flex or client portal;
- If you have your own account, you have access to much of your personal data and, as a candidate, flex worker or client, you can download the data for the right to data portability (transferability). You can also change some data yourself such as making changes to your CV, if applicable, or your account details;
- If the processing of your personal data is based on your consent, you also have the right to withdraw your consent, at any time. However, withdrawing your consent will not affect the lawfulness of any processing based on your prior consent before we have received such withdrawal or in the event further processing of the same data has continued according to another basis, such as a contract or legal obligation of ours.

We make every effort to protect your personal data to the best of our ability. We do this on the basis of our information security policy.
